TPS Venezuela is Partially Rescinded

The Issue

 

The Department of Homeland Security has rescinded Temporary Protected Status (TPS) for some Venezuelans. TPS was previously granted for Venezuelans in 2021 and expanded in 2023. DHS previously extended Venezuelan TPS for 18 months through October 2, 2026 for all eligible individuals. 

 

What to Expect

 

Individuals who obtained TPS in 2021 will continue to hold TPS through September 10, 2025. Based on the reasoning of the order we do not expect TPS will be extended beyond this date.

 

Individuals who obtained TPS in 2023 will have their TPS terminated as of April 7, 2025. This order is expected to impact over 348,000 people.

We expect that this particular order will be challenged in federal court. We will watch any potential litigation closely should the order be overturned or the rescission of TPS be overturned.
