Individuals seeking to file applications for adjustment of status with USCIS must use the “Dates of Filing” dates to determine when they can file such applications.
Dates of Filing:
All Chargeability (all countries except those otherwise listed):
- EB-1 is current
- EB-2 is August 1, 2023
- EB-3 is March 1, 2023
- EB-3 is May 22, 2021
China:
- EB-1 is January 1, 2023
- EB-2 is October 1, 2020
- EB-3 is November 15, 2020
- EB-3 other workers is January 1, 2018
India:
- EB-1 is April 15, 2022
- EB-2 is January 1, 2013
- EB-3 is June 8, 2013
- EB-3 other workers is June 8, 2013
Mexico and Philippines:
- EB-1 is current
- EB-2 is August 1, 2023
- EB-3 is March 1, 2023
- EB-3 other workers is May 22, 2021
Final Action Changes:
All Chargeability (all countries except those otherwise listed):
- EB-1 remains current
- EB-2 remains March 15, 2023
- EB-3 moved forward to November 15, 2022
- EB-3 other workers remains December 1, 2020
China:
- EB-1 moved forward to November 8, 2022.
- EB-2 moved forward to March 22, 2020
- EB-3 retrogressed to April 1, 2020
- EB-3 other workers remains January 1, 2017
India:
- EB-1 remains February 1, 2022
- EB-2 remains July 15, 2012.
